Show only the first upcoming instance of recurring events toggle not working

When in category view click the “Show only the first upcoming instance of recurring events” doesn’t work. You have to refresh the page to get it to work. Click next also then puts all recurrences back in the list until you refresh the page.
** Removed all non Tri.be plugins and on twenty twelve theme.
